I'm sure many people reading my web site will know how corrupt the british legal system and not a fair one and that includes the legal aid funding system it certainly not on the side of the victims in both criminal and civil cases, in other words its there to protect the judges,queens council,junior barristers,lawyer's, police officers the ones that who do wrong.

In my opinion why i think there are so many miscarriage of justice in civil and criminal action cases in this country and around the world can only fall into two categories the first one been is corruption right across the british legal system in all departments and among the legal profession and police etc, the other one is incompetence mentioned in the previous paragraph which is a big joke when these people are supposed to be highly educated , but lack experience in the real world for example they don't know much about the construction industry as this clearly demonstrates with my case. I think the means assessments to qualify to get legal aid is not in itself a good one as it affects so many people who can't afford the outrageous fees the lawyers charge and that's another subject. I think the level of income set down by the government and legal service commission for people to qualify for free legal aid should be raised on the net income so that every one has a fair chance of knowing funding is available for there case and get the financial assistance they need.Im not saying people shouldn't pay a contribution to there case its just makes it so more difficult when you have allot of expenditure to find e.g.,travel expenses etc can be very costly on a big case over a long period of time and this is on top of all your normal living expenses and trying to have a reasonable life under the circumstances you find yourself in so u add all this together with your legal aid contribution you have to pay then it becomes very hard on you financially especially if your wages,salary, is below a certain level and your suffering from a accident which resulted in very serious injuries. Another comment i would like to make about then legal services commission that iv' e come to learn over the many years iv' e been dealing with my case is that i think they waste far to much money in paying five lawyer's to sit on a review board when you have to present your case to prove funding should continue for instance lets say when have had a conference with a lawyer's, junior barristers or queens council and there advice states at the end that funding is no longer required or that your case has no merit when in fact your case does have At the present time i discovered on the internet there is £2.2billion that the government put into the legal aid fund for people to get access to solicitors and to take cases to court to enable people to get justice but we all know that there is no access to justice and the fact the huge amount of money mentioned goes to all the corrupt barristers and lawyers.

TAKE MY CASE FOR EXAMPLE.

This is down to one of the above three iv'e just mentioned not doing there job properly in looking at all the evidence on your case and giving proper constructive advice or to the fact he doesn't want the case to go any further for what ever his own reasons are.Then i noticed with the legal services commission they don't read all the advices properly from page one to the end they only tend to look at the very last page to see if funding should continue or not.Also they don't look to see if anyone of the above mentioned has made any mistakes in there advice's and doesn't add up to the evidence on your case which i think copies should be submitted along with there advices and legal aid application .In this instance the legal services commission shouldn't just pay up so easily in fact they should make any of the three above mentioned do there advice's again properly so that the client is totally happy with that advice given and according to the evidence on each individual person's case then this would save time and money in having to have a second opinion,so in effect the legal services commission wouldn't have to pay out twice on a first and second opinion and then pay out for a third time to five lawyer's on the review panel to just correct what should of been done right in the first place, so in effect its costing them to pay out from one person up to eight people to obtain advice on a case.

This would save a tremendous amount of money the legal services commission has to provide funding for and all these vast amounts of money that's been wasted would then be come available for many other people who needs legal aid funding on various cases,as the above always claim's they are short of funding for cases .I wonder why that could possibly be. The other problem in this country is that there is no proper independent body outside of the legal profession for people to go to when they know they have been a victim of a miscarriage of justice apart from the legal complaints service for solicitors and the bar council who most of the time just cover up for lawyer's even though they might fully well know they have been negligent or there conduct as a solicitor,or barristers is brought into question. They basically just advise you to go and see another solicitor who may take the case on but i imagine most lawyers wont go against each other even if they fully well know that your previous solicitor who had conduct of your case was negligent they just cover it up and try to bury the case so it never goes to court,

On the other hand they will be very few that will go against another lawyer's, also there are many types of miscarriage of justice cases who lawyer,s would be prepared to take on, if your not satisfied with the out come of your complaint with the legal complaints services for solicitors or bar council then you can take the matter further to the legal ombudsman . I have various dealings with the above departments over last 19 years nearly apart from the ombudsmen who i imagine is not much better,i also contacted 10 downing street ,the lord chancellors department, my local m.p.police complaints authority .So in some respect i suppose i was lucky i got my professional negligence case all the way to trial in december 2005 but where did that get me all i got was stabbed in the back by the lawyers along the way who were supposed acting in my best interests and then the trial and appeal judges just did the same to me. Now you can see the whole legal system is corrupt . in my opinion i think the situation will get allot worse and very few people around the world will struggle to get justice they are seeking with lawyer's and judges in the courts and its frightening to think of what the future holds for all of us.

They should rename the Legal Complaints Services to the following.

This one is a good topic that seems to upset most everyday hard working people is the outrageous fees that lawyer's do charge can't be justified in anyway as they are way beyond what the normal working people cannot afford to pay and also iv' e not met a lawyer who's works that hard to justify the outrageous fees they do charge or one even exist i think they need to get realistic about there fees so that's legal advice and help is available to every one at reasonable cost . Also i'm not saying they shouldn't make a healthy decent profit these law firms as there would be no point been in business but there is a vast difference between pure greed and a good profit and building a good reputation. In my opinion here should be an independent body outside the legal profession to govern how much lawyer's fees should be and capped at a reasonable level and just above the level the legal services commission pay.

JUDGES

I havn't had not much experience in dealings with judges so i can't comment to much apart from they are supposed to be impartial not in favor with one or another in other words they are suppose to be totally in dependant when they are sitting a case they should base there judgment on full evidence of fact.to each individual case,and should come down hard on lawyer's etc when they no full well they have been negligent and make a example of them as a warning to the rest of them that there there actions and behavior and how they treat there clients will not be tollerated.And also health and safety this to me should also be the up most priority of a high court judge sitting a professional negligence case or any type of industrial accident case.This did not happen in my case by the trial judge who was sitting my case in december 2005.These people should be setting a example to queens council,junior barristers,lawyer's of how a professional lawyer should conduct themselves and behave in a professional dignified manner,but saying that i also think there conduct as judges right across the judicial system should be brought into question as in my opinion it is not to a high standard expected from them as they are also in a position of privilege These comments are based on my own experiences and opinion from dealing with my own case and the standard and conduct of the trial judge and appeal judges which was dam disgrace full ,i'm sure allot of people will agree with me.

MY CONCLUSION

There is very little anyone can say regarding this subject apart from is that the whole judicial is run on corruption and incompetence by so called professionals what a dam joke these people are. there also needs to be some serious changes in the british legal system so all people are treated as equals and that everyone gets the right to a fair trial and justice is available to every man,woman and child,the british public needs to wake up to the reality of how corrupt our legal system is because it affects everyone and we should unite come together and stand up for our rights because numbers in masses goes along way and we would out number all the people who work and run our judicial system this needs to be done if we need to force dramatic changes and improvements to our judicial system . I am aware that the british judicial system is run independently from the government and i think this is a serious problem that needs dealing with as in this situation it leaves the judicial system wide open for abuse and corruption to incompetent judges,queens council,junior barristers,lawyer's .police officers,departments to continue working making mass sums of money when in fact they should be kicked out in disgrace without the big fat pensions.As most people know this very rarely happens and in most cases when anybody puts in a complaint regarding any of the above mentioned 99.9% of the time everything is just covered up so they just continue to abuse the system and this is why there is so much corruption .The only solution to deal with this serious problem would be to put the entire british judicial system under government control,and all complaints are dealt by them, in a department purposely set up and cannot be influenced in any way to cover things up,this may work but that would depend on who was put in charge, to sum up the british judicial system and police is they they are both criminal organization white collar criminals in suites and everyone of them wants locking up in prison and weld up the cells doors so there is no escape and left to rot in my opinion
