The Company's defence you will see from reading the original statements would of collapsed in court based on the following facts.

1 As you Can't Give evidence to something you did not witness.

4 A lso the lawyer's did not make a investigation to see if he was qualified to be a safety officer In my honest opinion and belief there was no actual legal policy draughted up that ever existed as you can see its only typed up on a company headed letter and there is no Policy number or any kind of reference to actually make it a legal document so in effect it would not form any basis of any evidence that could be used in court.

My honest opinion about gary hather is he didn't give a dam about health and safety in his own company my accident establishes that and the state of his defence basically he ran a cowboy firm he employed unqualified people for example at the time i started working for the company steven derbyshire had never served a apprentice to become a qualified plant fitter this in fact he told me himself so there was no guarantees any repairs and servicing he made to gary hathers machines were ever done to a high standard and they were ever done to manufactures guidelines correctly so in effect any bad repairs could of caused disasterous results .Also i honestly believe gary hather paid off my legal team in the professional negligence claim to stich me up and get himself out of the shit!! this is the type of man he his and is not a honest man to face up to his respectabilities of owning a plant hire company and in these circumstances i think his company should of been prosecuted The other thing gary hather would do was undercut other companies to hire out machines at ridiculous rates just to get work basically he was cheap as chips a good honest reputable firm would not need to do that and i think this is why his firm has lasted so long i know this is a fact as i have spoken to a few people who have worked for him since i was there in 1990 so nothing has changed may be he should add the following slogan to his website,

GARY HATHER PLANT HIRE CHEAP AS CHIPS TO HIRE ALL YOUR PLANT NEEDS
