From my own experience in dealing with my own industrial accident claims since january 17th 1990 i can only come to one conclusion on this particular subject which affects millions of people around the world in our every working day of our lives and when it is related to health and safety in the place of work.This should be the up- most priority to all company's around the world who have a duty of care to protect their employee's from serious injury , i will be totally honest about compensation claims in my conclusion at the end.

Many people work in very dangerous and high risk jobs and suffer beyond what most people can imagine when they have very serious industrial accidents which can end up destroying families and changing there lives forever to the point some people cant cope with and have to adapt there lives accordingly in a way most people find hard to do before they had there industrial accident .This i can honestly say that it cannot be measured in the terms of a final settlement that allot of people receive which i think are total outrageous to the point it's insulting to the victims .Lets face up to the facts nothing has changed in the slightest way since i was stitched up,shafted,stabbed in the back by the defendants in the professional negligence claim claim at the doors of the court in leeds on december 12th 1996 and not forgetting the trial judge in december 2005 and the appeal judges in may 2006

EXAMPLE

To prove my point lets take a look back over the year 2007 at a story that made the national six o'clock news , this was a story about the british miners who had genuine claims for industrial disease from the coal dust deep down in the miners , white vibration finger's from using jack hammers etc,the british government put up millions of pounds to cover the legal costs and to compensate the miners. I believe there were certain few law firms that was to deal with the miners claims.The story was basically about one such law firm based in doncastor south yorkshire and offices in barnsly who got very greedy and screwed a £140 million out of the money provided by the british government which by right should have gone to the miners for compensation,By the time the greedy lawyers took off administrative costs and the greedy middle men took there cut the miners ended up with very little compensation to which didn't amount to much in the first place .It was announced the following week on the six O'clock news they have to pay the money back as far as i can remember.

So my opinion on how lawyer's deal with industrial accident claims claims is not a very good one to say in the least, majority of them don't have a clue what they are doing take my claim for example it was a straight forward open and shut case and nothing complicated about it what so ever as they claimed from the beginning and how they managed to come up with the following advice there was a conflict of evidence between myself and the company's and they went on to admit they didn't understand the evidence from the manufacturers j.c.b at the trial in december 2005 really goes beyond the thinking of a normal person just amazes me.It goes to show you that they can't read the simplest of documents in front of them and form a opinion and give proper constructed advice any normal person would,also they make far to many mistakes for a person to be qualified as a lawyer .The valuations to industrial accident claims lawyers tend to come up with in my opinion are so unrealistic as when you break it down to the individual parts of what the claim is made up of then divide it over the years of your life you have to live, and the things you may have purchase,private care etc basically its worth nothing at all and you just end up with is a basic life and doesn't really cover the cost of future inflation costs or even a decent quality of life,i don't think they really want to admit or disclose to you what your claim could potentially generate if its done properly or if they can be bothered to fight for you to get what you really deserve depending on how serious your injuries are.Like my previous instructing lawyer on the professional negligence claim said to me in 2005 at some point in your life your compensation runs out so that confirms what i have set out above.

There are several publication of books which are basically about the values in money terms what people get for loosing various limbs and pain ,suffering ,loss of amenities etc .Basically lawyer's just tell you that's all you get for what they call general damages when in fact they are just guide lines for the starting point of valuation of your claim this was confirmed to me back in 2004 by a lawyer.they are totally ridiculous amounts as this also cannot be measured in real terms of money to the loss of peoples limbs as we depend on them so much in our daily lives .I know these publications are updated yearly but i don't think in great amounts as far as i know there are publications of these books are available for the public in your local library and law centers,and as far as i know there tables of interest that are applied to each part of your claim and multiplier's and to be honest i think are a dam disgrace and a bit of a joke..

From my own experiences which now is nearly approaching 19 years lawyer's,queens council lawyer's these people like to manipulate there clients and play on there vulnerability and don't give a dam about emotional , psychological distress here clients are in which has a dramatic affect on there way of thinking and not acting in a rational way which is no fault of there own. There cocky arrogance goes beyond belief and are over stepping the mark in which a professional man or woman should conduct themselves and are basically in a position of privilege.

The next part i'm going to deal with is the so called expert witness that lawyer's instruct on behalf of their clients like the ones on my case for example they also didn't have much of a clue what they were doing either as there assessment's were totally unrealistic and doesn't reflect to the true cost of living in the real world and future needs,and replacement costs that you may need for equipment,personal care etc. and inflation costs They also don't read all the evidence that is associated with your case properly just like lawyer's who both tend to make things up as they go along,and in my opinion are very incompetent and it appears they are not living in the real world.

In my own opinion is that all they just want is a peace of the action from your case to make as much money out of it as possible and the victim basically doesn't get a great deal out of it to make them think they have been truly compensated for there injuries.

The above opinion's is based on my own personal view's and my own experiences in dealing with my own claim in the last nineteen years allot of people reading my website will hopefully support my opinion's set out above,i certainly don't think the lawyer's would agree but the wouldn't really surprise me and most people . I also think the adverts on the television for personal injury claims help line numbers for people to contact if they have suffered a injury either at work,car accident etc are also habit of a joke and should be banned as in my opinion they are misleading people and the promise to them they will receive 100% compensation and justice . Even on my case three appeal judges said there was a high finding of contributory negligence on my part but you can see this was not so based on the evidence i have presented to you on my case on this website ,this was down to my instructing solicitor obstructing my case by not carrying out my simple instructions by informing queens council the evidence on the safety step that was used at the trial december of 2005 was not included in the appeal file documents .This situation is obviously different to the adverts on the television, but it still doesn't alter the fact these television adverts are just sales pitch at the end of the day.

CONCLUSION

So my final conclusion and opinion on industrial accident,personal injury claims its just a big con as the victims basically don't get a great deal in compensation for all there trauma, ,suffering from there appalling injuries they have sustained in a accident and having there whole lives turned up side down for ever,And my opinion is that the majority of lawyers basically don't have clue how deal with accident,personal injury claims and also its just easy money making racket for lawyer's .I honestly believe they are taking the piss with the compensation claims.
