Why didn't the defendant's in the present action do the following apply for a adjournment instead of advising to settle the case in the way they did.due to the late evidence from the manufactures jcb and get mr allsop to come to court to explain and give evidence in court regarding the evidence he provided in letters of august-december 1996.

He also commented on health and safety issues to this case as to why the manufactures jcb had claimed in there letter dated december 1996 to the fact why operatives had to stand in the dangerous position on the main frame in order to refuel the jcb.3cx site master model i had my accident on,and why the defendants in this present action didn't had the common sense to investigate this further.

And that if the defendants in the original action this been gary hather plant hire denied it was a two man operation to refuel up the jcb in question and to stand in the position that i did on the main frame then the evidence from the manufacture's jcb becomes a powerful piece of evidence.

I would like to point out to the fact i wasn't given the option mentioned in paragraph 1 had no choice but to accept the situation and position they put me in on the morning of december 12th 1996.

This clearly indicates by the above said by the trial judge in december 2005 that the defendants in the present action they were negligent in advising me to settle the case and negligent in not advising me of getting my case adjourned Also i have two queens council and two junior barristers who agree in there advices,opinions, trial submissions the defendants in the professional negligence case were just as negligent as gary hather plant hire in the original action.

I WOULD LIKE TO MAKE THE FOLLOWING STATEMENT

The above is from my 100% recollection of what the trial judge said during the coarse of the trial in december 2005 and not just something that i've just made up,as i do not suffer from a bad memory i would also like state that everything that i have published and claimed against the lawyers and judges that they all have obstructed justice from been done is backed up by documented evidence of fact on my web site,and the fact none of them have done there job properly.
